As we know that the Companies Act, 2013, an Act to consolidate and amend the law relating to companies, has replaced 57 years old Companies Act, 1956 with effect from 29th August, 2013 and the same was notified in the Official Gazette on the very next day i.e. 30th August, 2013.
The Act contains 470 sections under 29 chapters with seven schedules. However, currently there are only 432 (470+1-39) sections remains in the Act. Out of those 432 sections, the Ministry of Corporate Affairs has already notified 430 (1+98+1+183+1+1+5+37+1+7+88+5+1+1) sections and majority of the Rules to the various Chapters/Sections of the Companies Act, 2013. Only two sections i.e. 132, and 465 are not yet notified.
The first amendment to this Act has received the assent of the President on May 25, 2015 and may be called the Companies (Amendment) Act, 2015 (21 of 2015). Thereafter, the Companies (Amendment) Act, 2017 enacted by Parliament in the Sixty-eighth Year of the Republic of India after receiving the assent of the President on the 3rd January, 2018.
